Lekker International Terms and Conditions

 

By becoming an Associate of Lekker International you agree to abide by the Terms and Conditions listed below. Lekker International reserves the right to revise this information at any time. Lekker International uses the term Associate, Independent Associate, as one and the same.

 

Violations of the Company Code of Ethics, Participant Agreement, or the written Policies and Procedures may be cause for cancellation of participation. Please read through these Policies and Procedures carefully to fully benefit and understand your rights and responsibilities as a Lekker International Associate.

 

Who is Lekker International?

Lekker International believes in the power of the individual. We will provide opportunity, travel and financial opportunities to associates that will create a Lekker Lifestyle.

 

What is your role?

As a Lekker International Independent Associate, you are in charge of your own destiny. We will provide all the resources you need for success, but it is up to you to use these as directed.

 

How do I become involved with Lekker International?

Access to Lekker International is obtained by invitation from another Lekker International Associate. Access to Lekker International is provided with the purchase of a Lekker International "Lifestyle Pack".

 

What is a Lifestyle Pack?

A Lifestyle Pack provides access to a range of benefits and privileges through a selection of preferred independent product and service providers. This includes access to:

• Discounted travel services
• Holiday Rewards to redeem agains the cost of your travel purchases
• Home Based Business Opportunity

These privileges and benefits are available to the Associate for one year from the date of purchase of the "Lifestyle Pack" upon which the Associate can renew their purchase of their "Lifestyle Pack" to continue to receive the benefits.

What happens if I do not renew the purchase of my "Lifestyle Pack"?

If you do NOT renew you lose access to all the Lifestyle Pack benefits. You also lose the ability to earn any further rewards from the sales team you have developed.

 

Will I be notified about my renewal?

Yes. We will send a series of text messages to the mobile phone of the purchaser and emails from day 30 before the expiry date to inform the purchaser that their Lifestyle Pack is due for renewal.

 

Will the Associates introduced by an Associate that fails to renew?

The personally introduced Associates will roll up and become the personal introductions of the next financial Associate in the line of introduction.

 

Does my renewal generate another position in the genealogy?

No. The renewal will add one more stored sale to the volume of the upline.

 

Purchase of the Lekker Lifestyle Pack

The person purchasing the Lifestyle Pack accepts that they are responsible for paying any additional fees associated with processing payment for their purchase from Lekker. This includes credit card processing fees, bank wire fees, agent fees and other fees charged by third parties used to process payment.

 

Refunds

Lekker International offers a 14 day trial of the Lekker product and business opportunity before payment is due  Hence it is assumed that if a person chooses to make payment during that 14 day period they are 100% satisfied with what they have purchased.  Based on this premise, no refunds are offered.

 

Introducing NEW Associates to Lekker International

Introducing new Associates and selling Lifestyle Packs is totally optional. When an existing Associate introduces a new Associate they have the responsibility to assist, train, develop and monitor the new Associate they introduce, in the various aspects of the program.

 

Every person has the right to choose his or her own introducer. If two Associates should claim to be the introducer or sponsor of the same new Associate, the Company shall regard the first Application received as controlling.

 

A sponsoring Associate must not exaggerate the earning potential that may result from this business opportunity.

 

A sponsoring Associate is obliged to fairly and fully explain the marketing plan to all prospective Associates, making sure to stress that the degree of success is directly related to individual effort and ability.

 

Can an Associate purchase MORE than ONE Lifestyle Pack

Lekker International Associates may NOT purchase additional "Lifestyle Packs". Lekker International Associates may NOT have multiple accounts under different sponsors.

 

Please note that Lekker International does NOT encourage the purchase of multiple "Lifestyle Packs" to participate or advance in the rewards program. Any Associate who advises prospective applicants of anything otherwise will be in violation of this agreement and subject to penalties as set forth herein.

 

Relationship of the Associate to Lekker International

Associates representing Lekker International are known as independent Associates, and have no authority to bind the company to any obligations. The relationship between Associates and Lekker International is established only by this Agreement. An Associate is not an agent, employee or any other legal representative of Lekker International or its service providers.

 

Associates are solely responsible for all self-employment taxes and any federal, state, local or other taxes that may be due as a result of their Lekker International business activities. Associates agree to abide by any national, federal, state, provincial, county or local laws, rules and regulations pertaining to this Agreement. At Associate's own expense, Associates will make, execute and file all such reports and obtain such licenses as are required by law or public authority with respect to this Agreement.

 

Associate CODE OF ETHICS

1. I will follow the highest standards of honesty and integrity in all that I do.
2. I will not make negative or disparaging remarks about Lekker International, their officers and employees, other people, products or firms.
3. I will present our marketing plan accurately and honestly, clearly portraying the level of effort required to achieve success.
4. I will carry out all the duties of sponsorship and responsible leadership as I develop my sales team. I will treat everyone, whether they are in my sales team or not, with the same courtesy.
5. I will not promote Lekker International as a Tax avoidance scheme.
6. I will not produce marketing or training aids of any kind for sale to other Associates without the prior written permission from Company.
7. I will consistently put forth my best efforts to promote the success of my business. I will not engage in activities that will cause loss to another Associate or Lekker International.
8. I will abide by all Policies and Procedures that pertain to the operation of my business.

OVERVIEW OF POLICIES AND PROCEDURES

1. An applicant is considered to be a duly authorized Independent Associate, herein after called the Associate, if Lekker International accepts the completed Associate Application and Agreement.
2. Company reserves the right to accept or reject any Associate Application and Agreement form without having to assign any reason for its acceptance or rejection.
3. All Associates are independent contractors and are neither agents nor employees of Lekker International.
4. The Associate is responsible for bearing all costs and expenses incurred in the conduct of their participation.
5. An Associate must be 18 years of age.
6. An Associate must have only one introducer (sponsor).
7. Husbands and wives, married or de facto, may sponsor each other or have different sponsors. This also applies to any interlocking directorships or share holdings that may exist from a business/Associate relationship.

However it should be noted, that all Associates must meet their own personal qualification levels to qualify for the rewards from the Rewards Program.

 

If a married couple have joined as one Applicant and become divorced, the account shall be maintained in the name of the principal Applicant on the Associate Application unless the company receives a certified copy of Divorce Decree which orders otherwise. An Associate cannot resign and rejoin under a different name.

 

Maitenance of Associate Account Information

It is the responsibility of each Associate to update their account information such as their email address and cell phone details to ensure they can receive updates from Lekker International. These updates are also posted in the "NEWS" section of the Lekker International Virtual Office of each Associates website. Lekker International will bear no responsibility for any loss (moral, physical or financial or legal or any other kind of loss) caused by entering wrong information into registration form/ misrepresentation by Associates or any other person.

 

Security

Each Associate must keep any Lekker International passwords and other secure access information confidential and notify Lekker International promptly if the Associate believes that the security of an account has been compromised. Lekker International has taken reasonable steps to protect the security of online transactions. However, Lekker International cannot and does not warrant such security and will not be liable for any losses or damages resulting from any security breaches.

 

Trademarks and Marketing Materials

Associates will not use the Lekker International trade names and/or trademarks except to promote Lekker International. In all such authorized use, Associates will ensure that they represent themselves as an independent representative and that all marketing efforts are the responsibility of the Associate and not the company.

 

Any sales and marketing materials supplied by Lekker International may NOT be on sold to other parties at a profit and that any purchase of these materials from Lekker International does not qualify the Associate for any reward payments.

 

Lekker International makes no warranty, express or implied, with respect to the use, efficacy or suitability for any purpose with respect to any such marketing material unless otherwise explicitly stated in writing in connection with the purchase thereof.

 

Domains and website addresses

Associates may not use the name "Lekker International" in a domain name to promote Lekker International without asking permission from Lekker International. This includes any extensions of this name such as "Lekker International Team", "Lekker International Group", etc. This is to protect the branding of Lekker International and to prevent any person thinking that any other website address or domain name is representing Lekker International corporately. Any Associate found using the word Lekker International in their domain name will be asked to remove this domain name. If the Associate does not comply they will risk termination of their account and participation in the rewards program.

 

Third party materials created by Associates

Associates may create their own marketing materials. Any marketing materials that use the name Lekker International or any of Lekker International's logos, trademarks or trade names MUST be approved by Lekker International compliance department before they can be used.

 

Please note that may NOT put any website online that promotes Lekker International until you receive a compliance approval number from Lekker International. This number must be placed on the website along with the following wording.

 

"This website is owned by an Independent Associate of Lekker International"

 

A Compliance Approval Form is available in the secure Associates login area.

 

Lekker International has no liability or responsibility for any content, including the quality, accuracy, completeness, legality, or usefulness of any information, product, service or process promoted on any web site or other marketing materials NOT produced by Lekker International.

 

In no event shall Lekker International be liable for any claims or damages of any kind arising from the contents of any website or marketing materials created by An Associate. References in an Associates website or marketing materials to products, services, processes, hypertext links to third parties or other information by trade name, trademark, manufacturer, supplier or otherwise do not constitute or imply an endorsement or recommendation by Lekker International.

 

Advertising

Advertising in any form that refers to "Lekker International" must be approved by the compliance department. This includes advertising in; newspapers, magazines, on flyers, letter box drops, radio, television, recorded messages on answering machines, barter card type systems and the like, any telephone directories, White Pages, Yellow Pages, local directories and the like. Associates are only permitted to promote and/or advertise themselves as Independent Associates of Lekker International.

 

Associates are not permitted to take advantage of Company's name and are therefore not permitted to either infer or imply that they have a direct association or affiliation with Company by promoting themselves by way of Lekker International name variations.

 

All advertising and promotional material authorized by Company can be used by Associates. No Associate will be permitted to have exclusive rights to approved advertising and promotional material. Failure to comply will result in the immediate cancellation of the offending Associate.

 

Literature

Lekker International produces approved literature for use by Associates. All promotional material appearing in the Associates Virtual Office is approved for downloading to print and copying onto disc for promotional use to prospective Associates however it may not be altered or added to in any way.

 

Media

No Associate may speak for Lekker International by way of an interview on radio, television or through the press, including any periodical. If approached for such purpose the Associate should contact Lekker International.

 

Compliance Approval

All submissions for compliance approval can be made by completing the form in the Associates secure login area.

 

Lekker International Website

On occasion, Lekker International will undergo routine maintenance or experience unexpected technical problems. Lekker International will make a good-faith effort to do maintenance as quickly and conveniently as possible, and to respond to technical problems promptly. Lekker International may be required to access an Associate's web site from time to time to provide maintenance. Lekker International will not in any circumstance be responsible for problems, losses, or damages arising from loss of connectivity; errors in content due to application problems; loss of access by Associates; or temporary or permanent loss of data.

 

Promises made by Lekker International Associates

When An Associate presents Lekker International to others they should understand all aspects of the rewards program and not make any representation or promise that is not contained in this agreement or in Lekker International corporate literature and promotional materials. This representation includes print media, video/audio media or any other form of advertisement/ promotion.

 

If a prospective Associate relies on any promises made by a Lekker International Associate that is not stated in this Agreement and/or official company materials, and the Associate fails to keep any such promise, the prospective Associate shall only have recourse against the Associate and not the company.

 

If the Associate has unfulfilled promises made they have the option of lodging a complaint with Lekker International. Upon receipt of such a complaint, the Company will investigate the matter as it deems necessary and, upon validation of such a complaint, impose appropriate penalties on the offending Associate. Such action however will not result in any recovery of damages by the prospective Associate, which the prospective Associate is free to seek against the offending Associate, not the Company.

 

Income representation

Associates understand that any rewards that are offered from Lekker International through the rewards program is the result of Associates selling "Lifestyle Packs" to other willing Associates. Advancement in the rewards program is NOT based solely on the introduction of other Associates.

 

No Associate may make any promise or guarantee that An Associate will derive any specific income or profit from the rewards program as an Associate of Lekker International. Any rewards or income an Associate receives through the rewards program is a direct result of the marketing efforts of the Associate and any Associates in their sales team. Associates must meet the required qualifications as set out by Lekker International to receive rewards from the rewards program.

 

Misrepresentation

Associates will not misrepresent Lekker International in any manner whatsoever at any time.

 

For purposes of this policy, misrepresentation includes, but is not necessarily limited to the following:

1. Reviewing the marketing plan with any person without clearly advising them that no remuneration is received solely for enrolling or sponsoring new Associates.
2. Reviewing the marketing plan with any person without clearly advising them that there is no requirement to pay a fee other than the purchase of the "Lifestyle Pack".
3. Stating that any person has made or may make any specific income through the use of the marketing plan and by the generation of income, whether by specific example, geometric progression, or otherwise. Unless in the same presentation it is stated that said hypothetical or potential earnings, as earnings may vary due to individual efforts, geographic location, timing and many other factors.

 

Policy Changes

Associates agree that Lekker International may from time to time make changes to it's benefits and privileges, product and services, pricing, rewards program or to this agreement applicable to all Associates. Associates will be made aware of changes via email or sms to the email address or mobile phone listed in their account details as well as posting updates in the NEWS section of the Lekker International Virtual Office of the Lekker International website. It is the responsibility of each Associate to ensure the email address listed in their account is valid and that they check regularly their Virtual Office for the latest updates. Associates agree to abide by all changes.

 

Confidentiality

Associates understand that the Lekker International marketing plan, details of their progress in the rewards program, details of their Lekker International sales team, and official company literature are proprietary information and considered trade secrets of Lekker International.

 

Associates hereby agree to not directly or indirectly disclose or use any of said confidential or proprietary information except to specifically promote the Associates independent Lekker International business in accordance with the provisions of this Agreement. Associate further agrees that this provision shall survive the expiration or termination of this Agreement for a period of one year.

 

Sale of participation and "Lifestyle Pack"

An Associate may sell their "Lifestyle Pack" and the participation position in the rewards program attached to that account, called a Username Account. It can be sold to anyone who is NOT a current Lekker International Associate or to anyone in the line of sponsorship above the selling Associate.

 

For Lekker International to acknowledge the sale the selling Associate must supply proof of the sale in the form of a signed letter by both parties detailing that the sale has been made as well as providing details of the purchaser including all the fields listed in their profile. The documents can be emailed to support@lekkerinternational.com. Lekker International will advise the seller and the purchaser by email if the sale has been approved.

 

Associates who sell their Lekker International business must wait six months after the sale has been executed and authorized by the Company before they can rejoin as a new Associate.

 

Cancellation

Should An Associate wish to cancel their Agreement with Company the Associate should notify Lekker International by the help desk. If the participation is cancelled, that Associate may not apply for new participation for at least 6 months after Company has received the notice of cancellation. Company reserves the right to cancel An Associate Agreement should there be any breach by the Associate of the Agreement.

 

Who will inherit my Lekker business?

The Lekker International Account belonging to an Associate, like any other business or asset An Associate may have, is fully transferable in accordance with the terms of a Will, or, in the absence of a Will, it passes to the heirs pursuant to the applicable interstate succession laws. For those Associates whose Lekker International Account is owned by a corporation (or some other type of legal entity), there would be no change in the ownership of the Account upon the death of an owner of that corporation, etc. Ownership of the corporation would change by passing to the heirs, but the corporation would continue to own the Lekker International Account.

 

Indemnity

Associate indemnifies and holds Lekker International harmless against all claims made by any third party, and any related damages and expenses (including reasonable attorney's fees), arising out of or connected with the Associates conduct, the associate's website or online store, the goods or service the Associate offers, or any violation of this agreement by associate.

 

Limitation of liability

Lekker International makes no warranties, express or implied, related to the "Lekker International Marketing Programs", products or services supplied there under or, including but not limited to warranties of merchantability and fitness for a particular purpose. Lekker International will not be liable to any Associate for indirect, incidental, special or consequential damages, such as (but not limited to) loss of profits or business interruption, arising out of or connected to the use of, or inability to use, the " Lekker International Marketing Programs", related services, products or marketing materials provided to any Associate. The total liability of Lekker International for any and all damages arising from or connected with this Agreement, the "Lekker International Marketing Program" or the services, products or marketing materials provided to any Associate shall not exceed the total fees paid by the Associate to Lekker International during the 12-month period immediately preceding the initial occurrence of the event causing the damages.

 

Imposition of penalty

If Associate breaches any of the provisions of this Agreement, violates any applicable law or regulation or engages in any false, misleading or unfair trade practice, including but not limited to, making misleading income representations or making promises to potential Associates that cannot be kept by Associate, (herein called "Violation") any such Violation is grounds for the imposition of penalty, as more fully set forth hereafter.

 

Depending on the severity of the breach the Company may suspend the Associate, including suspension of rewards earned at the time, pending investigation of any alleged Violation. The Associate shall be given notice of the alleged Violation by e-mail, fax or other rapid method of communication and shall have 14 days thereafter to respond in writing (verbal response will not be considered) to any alleged Violation (s), failing which, the Company can consider the allegations to be true. (It is Associate's responsibility to see that Company receives the response, with supporting documentation, if any, within the fourteen-day period.) If at the end of the investigation it is determined that Associate is to be penalized, the date of the imposition of the penalty can be, at the Company's option,

1. the date of the penalty notice
2. the date of the notice of the alleged violation
3. the date on which suspension, if any, occurred, or
4. any other current date.

Incomes suspended and/or earned, if any, as of the date of a termination, shall be paid less any costs or fines due to Lekker International. An Associate can request that any decision to impose a penalty be reviewed and supply any additional material that may bear on the matter in support thereof within seven days after notice of the penalty is given. Company shall then advise the Associate of its final decision. The Company shall have the option of imposing any one or more of the following penalties for Violations:

• Disabling of Account of the Associater;
• Denial or revocation of any achievement awards otherwise earned;
• Imposition of a fine in an amount to be determined by the Company; and/or Termination of the Associate's Agreement.

No extension of time or indulgence granted by Lekker International to the Associates shall be deemed in any way to effect, prejudice or derogate from the rights of Lekker International in any respect under this Agreement, nor shall it in any way be regarded a waiver of any rights by Lekker International hereunder or a novation of this Agreement.

 

Official Languages/Definitions

The English version of this Agreement, as maintained by Lekker International is the official version and shall control over any other language version(s) which may be made available for ease of reference for some Associates. As used in the Lekker International materials, when the term, "sell/enrol" and words of similar import are used to describe the enrolment/ sales activities of Associate, this is an abbreviated reference to the promotional activities of Associate with respect to sales and it is understood that all sales are between the Company and the purchaser, not between the Associate and the purchaser. Likewise, when the term, "recruit" and words of similar import are used to describe the referral and recruiting activities of Associate, this is an abbreviated reference to the team building activities of Associate and it is understood that the agreement by which one becomes An Associate is between the Company and the recruited Associate and not between the new Associate and the referring Associate.

 

Incorporation of agreements

If Associate has enrolled in a "Lekker International Marketing Program", the User Agreement and Acceptable Use Policy are incorporated herein as if fully set forth.

 

Entire agreement

This Agreement constitutes the entire agreement between the parties on the subject matter hereof, and no other additional promises, representations, guarantees or agreements of any kind shall be valid concerning such subject matter unless in writing and signed by an authorized officer of Lekker International.

 

Responsibility

The Lekker International is not responsible for the acts of its Associates under any circumstances for their wrongful and illegal activities.

 

Applicant acknowledgement

Associate acknowledges that Associate has read understands and agrees to the terms set forth in this Agreement. Associate understands that this Agreement is not in force until accepted.

 

Anti-SPAM policy

COMPANY HAS A ZERO TOLERANCE ANTI-SPAM POLICY.

 

THIS MEANS THAT ANY TEAM LEADER OR Associate OR RELATED Associate THAT SPAM'S IN ANY WAY SHALL BE IMMEDIATELY TERMINATED WITH ALL RIGHTS FORFEITED.

 

The following Acceptable use (Anti-Spam) policy sets forth what activities on the part of a Company Associate will not be tolerated under any circumstances. These policies will be enforced to insure Lekker International continued reputation remains as a high quality, professional company. Company will immediately terminate any Associate found engaging in spamming or any illegal activity. Their participation shall be terminated and they will be charged two hundred dollars for each reported spamming activity as a penalty and damage charge. Company will immediately contact state and federal authorities to report such activity as it is a crime in many jurisdictions to Spam.

 

Any Associate, person or entity found spamming will have their relationship to Lekker International terminated when Company receives complaints from any part of the Internet community and verifies same. All Associates are required to agree and adhere to these stated conditions. An Associate cannot violate any applicable local, state, federal or international law. Illegal spamming activity includes posting identical or substantially similar articles to an excessive (more than 3) number of news groups or continued posting of articles which are of topic for a newsgroup; Sending unsolicited mass (to more than 10 users) emailing which provoke complaints from the recipients or where the recipients have not agreed, prior to such mailing to accept such emails. Unsolicited commercial advertisements will be treated as illegal Spam.

 

Lekker International will fully co-operate with all criminal authorities to provide information as to the person that engages in spamming activity in order to obtain warrants and criminal charges against the Associates responsible for spamming.
